The Unions Duty Of Fair Representation - 876 Words
The unions duty of fair representation as stated in (FLRA, 2016)is the obligation set forth in the second sentence of section 7114(a)(1) of the Statute is commonly referred to as an exclusive representative s duty of fair representation. The Authority has interpreted this section to require an exclusive representative to represent the interests of all bargaining unit employees: 1) without discrimination; and 2) without regard to whether the employee is a dues paying member of the exclusive representative. The duty of fair representation is grounded in the principle that when a union attains the status of exclusive representative, it must use that power to fairly and equally represent all members of the unit. The union has met its obligation of fair representation when it has represented the employee fairly, in good faith, and without discrimination. In my opinion the union in the case cited did not meet its fair representation obligation due to not representing Green in good faith or without discrimination possibly on the grounds she is a non-dues paying employee. Therefore, her rights under the LMRA have been violated due to unfair labor practices. This learning experience could be beneficial for me to develop the hypothesis in further research. I have also developed my understanding regarding qualitative and quantitative research. In this way, it can be evaluated that qualitative research is used to gather the non-numeric information regarding research topic[5]. It is analyzed that qualitative data can be gathered from different previous cases in which social media has helped or adversely impact on the performance of the organization[6]. Further, I have learned that quantitative research is beneficial to gather numeric based data that can be analyzed through statistical method. It is analyzed that these data are gathered from the questionnaire, survey, and polls. It can be either descriptive or experimental in nature[7]. Application of learning in future This learning will be applied by me within an organization to build an effective digital marketing strategy. It could be beneficial to improve the productivity and profitability of the company as I can become a good marketing manages in future. This can not only meet my short term goal but also beneficial to attain my long-term goal such as to become a successful entrepreneur. From this research, I have learned that there are different limitations of research. These limitations are lack of generalization, inappropriate action, and lack of technology[8].
